Non-Standard Flight (“NSF”) Portal Terms of Use

Thank you for selecting our NSF Portal services (the “Services”). The Services are provided to you by NATS (En Route) PLC (“NATS”), a company registered in England and Wales with company number 4129273 with registered address at 4000 Parkway, Whiteley, Fareham, PO15 7FL.

By using our Services, you are deemed to have understood and agreed to these terms and conditions that are supplemental to the main Terms and Conditions and Privacy Notice attached to the nats.aero website which you are also deemed to have accepted.

Please note that the NSF Portal is currently in beta version.  We shall update these terms and conditions when the version is available for general release.

  1. BACKGROUND

You may use the Services to submit an application to enter controlled airspace below flight level 195.

The NSF Portal (beta Version) is provided in accordance with the Civil Aviation Authority’s Aeronautical Information Publication, which states the requirements and provides detail regarding access to controlled airspace, including details of drone flight restriction zones.

  1. YOUR OBLIGATIONS

You must at all times comply with the conditions and obligations set out in the latest Air Navigation Order and you are responsible at all times for the safe operation of your aircraft. You remain responsible for ensuring you have all the information necessary for the safe conduct of any flight and that you adhere to the laws of any area over which you fly.

It is your responsibility to ensure that you have the correct devices and third party services in place to use and access the Services.  [As stated above, the NSF Portal is currently in beta version; as such, please be aware that it is still subject to testing before general release.]

For manned aviation, any NSF approval does not constitute a clearance to enter controlled airspace.

NATS bears no responsibility for verifying the accuracy or authenticity of each request.  Users of the Services remain responsible for the accuracy and authenticity of each request.

  1. NATS’ PROVISION OF THE SERVICES

A request will be approved or rejected as soon as possible after submission to the NSF Portal*. Advance approval does not constitute an approval to fly; the user must activate the advance approval and obtain further approval from ATC on the day of flight.

* Please note: applications in Restricted Areas R157, R158 and R159 may take up to 28 days.

Whilst NATS shall make all reasonable efforts to deliver uninterrupted Services and to provide users with prior notice of any planned disruptions to the Services, NATS accepts no responsibility for any disruptions to the Services.

In the event that NATS intends to stop providing the Services, it shall use reasonable endeavours to communicate an end date to current users.

  1. DATA AND PRIVACY

Data entered into the NSF Portal by users (“NSF Data”), excluding any personal data contained therein, shall become NATS property and shall be held within the United Kingdom.

NATS will handle personal data contained within the NSF Data in accordance with the privacy notice attached to the nats.aero website at: https://www.nats.aero/home/privacy-notice/.

  1. GENERAL

By submitting information to or via NATS as part of your use of the Services, you accept full responsibility for the submission of accurate, authentic and correct data.

NATS may review content to monitor NATS’ system performance and to audit users’ use of the Services, and NATS reserves all rights to remove or refuse to display content that we reasonably believe violates the terms of this Contract, our policies or the law.

NATS reserves the right, at its discretion, to make reasonable changes to any part of these supplemental terms and conditions. In such event, NATS will publish the updated terms and conditions online. Any changes shall take effect from the date of online publication.

  1. COMPUTER VIRUS

You shall take all measures necessary to ensure that your equipment and connection to the Services will not corrupt, interfere with or damage NATS' systems.

NATS shall use reasonable endeavours to protect the Services from computer viruses, worms and trojan horses (destructive features) but does not warrant that the NSF Portal is free from all destructive features and accepts no liability for any damage that may result from the transmission of any such destructive feature. You must take your own precautions to ensure that the process you employ for accessing the Services does not expose you to the risk of viruses, malicious computer code or other forms of interference which may damage your own computer system.

  1. LIABILITY

All conditions, warranties and representations, expressed or implied by statute, common law or otherwise, in relation to the supply, non-supply or delay in supplying the Services are excluded to the fullest extent permitted by law.

To the maximum extent permitted by law, NATS excludes all liability for the provision of the Services whether in contract, tort (including negligence or breach of statutory duty) under any indemnity or otherwise in respect of each event or series of connected events or in the aggregate.

Nothing in this Contract shall operate to exclude or restrict NATS' liability for death or personal injury resulting from NATS' negligence as defined in the Unfair Contract Terms Act 1977; and fraud or other matter if and to the extent that, under the laws of England and Wales, liability for it cannot be excluded, restricted or limited as against the User in the context of this Contract.

The software used to provide the Services is in the form of a Beta trial and has not been certified by any governing body and the Services are used at your own risk. NATS provides no warranty regarding the accuracy or currency of maps used within the NSF Portal.  Your use of the NSF Portal, therefore, should not replace proper flight planning and preparation as required by law and best practice.

You shall indemnify NATS against all damages and loss from your misuse, abuse or negligent use of the Services.
